• When does my business have to be smoke-free?
South Dakota's smoke free law goes into effect
November 10, 2010.
• Does my business need to be smoke free?
The State’s ban on smoking now applies to all
restaurants, bars, package liquor stores, Deadwood
casinos and video lottery establishments. It requires
owners, managers, and operators of places where
smoking is prohibited to inform violators of the
smoking ban. The ban does not apply to tobacco
shops, hotel rooms designated as smoking rooms,
and existing cigar bars.

• How can I report a violation?
Employees and the public may report violations of the smoke-free law to local law enforcement agencies through their non-emergency phone number.
• I'm a business owner, should signs be posted?
The law requires owners, managers, and operators
of places where smoking is prohibited to inform
violators of the ban. Window clings are available
